JustOCR.com is a web-based service that makes PDF documents searchable through the process of Optical Character Recognition (OCR).

JustOCR is cloud-based software hosted by Amazon Web Services. JustOCR uses region-specific S3 storage as selected by a new user when signing up for the service.

About www.justocr.com (the “Website”)

This Website is created and controlled by Corrs Enterprises Holdings Pty Ltd (ABN 76 613 509 998) (“CEH”). References to “CEH”, “we” or “us” in these Terms of Use are references to CEH and/or its associated entities, as appropriate. 

These Terms of Use apply whenever you access or use the Website. By accessing or using the Website you will be deemed to accept these Terms of Use as they exist at that time. 

CEH reserves the right to amend these Terms of Use at any time at its sole discretion. Your continued access to the Website will constitute your acceptance of any changes or revisions to these Terms of Use. 

Copyright and trade mark notice

This Website is protected by copyright owned by or licensed to CEH. You may download and print content from the Website for your own personal or internal business purposes only. However you must not publish, adapt, communicate to the public, distribute to third parties, amend or make any other copy of any part of the content on the Website without our prior written consent. 

We grant you a license to download one copy of any instruction manual or user information (“Materials”) from the Website for your personal or internal business purposes only. Under the terms of this license, you cannot modify or copy the Materials, use the Materials for any commercial purposes, remove any copyright or other proprietary notices from the Materials, transfer the Materials to another person or “mirror” the Materials on any other server. You must not use the JustOCR™ trade mark without our prior written consent.

Linking and framing

The Website may contain links to other websites and may on occasion display content or information from other websites within frames on the Website. We are not responsible or liable for that content or information, and do not warrant the accuracy, currency or suitability for any purpose of that link and information. 

You may link to our Website provided that you do so in a way that accurately indicates that the link is to a CEH page and is not misleading.

Cookies

We may use cookies to identify your computer on our server and so we can track your use of the Website. In some instances cookies may collect and store personal information about you. Such personal information will only be used by CEH in accordance with our Privacy Policy.

Privacy

Any personal information we collect about you via the Website or otherwise will only be used and disclosed by CEH in accordance with our Privacy Policy.

Liability

To the maximum extent permitted by law, we will not be liable to any person or entity for any direct, indirect, consequential or other loss or damage (however caused, including due to negligence) which may arise out of, or in connection with, the use of the Website or the use or reliance on information, including any publication or media release, contained on or linked to or from the Website. Further, we do not endorse or accept any liability for the contents of any website referred to on, or linked from, the Website. 


We do not provide any warranty in relation to your use of the Website or as to the currency, completeness or accuracy of the information contained on the Website. 

If any law implies a condition, warranty or guarantee into these Terms of Use which cannot lawfully be excluded then, to the maximum extent permitted by law, our liability for any breach of such implied condition, warranty or guarantee will be limited to the supply of the relevant service again or the payment of the cost of having that service re-supplied.

Governing law

These Terms of Use are governed by the laws of Victoria, Australia, and in the event that we have a legal dispute relating to the Website or these Terms of Use, Victorian courts will have non-exclusive jurisdiction.

JustOCR service Terms and conditions

Welcome to JustOCR™ (the “Software”). These are our Terms and Conditions for use of the Software. These Terms and Conditions apply whenever you access or use the Software. By accessing or using the Software you will be deemed to accept these Terms and Conditions. If you do not wish to accept these Terms and Conditions, you must not access or use the Software.

Use of the software

Corrs Enterprises Holdings Pty Ltd (ABN 76 613 509 998) (“CEH”) is the owner and operator of the Software and is solely responsible for the Software and its content.

Users of the Software (“you”) agree to be bound by these Terms and Conditions, which are subject to change at CEH’s sole discretion. By accessing or using the Software, you agree to be bound by these Terms and Conditions, as they exist at that time.

CEH may at any time (without prejudice to its other rights or remedies) immediately terminate the Software licence granted to you in the event that you fail to comply with these Terms and Conditions.

JustOCR™ licence

The JustOCR™ software allows you to upload and convert PDF documents into Optical Character Recognition (OCR) processed PDFs that are amenable to text searches.

Subject to this paragraph 5, you may use the Software to upload and OCR process documents. Such documents will be deemed to be Content. CEH does not authorise you to process any Content. It is your responsibility to obtain any necessary permissions under copyright laws or any other laws. You warrant that you have all necessary rights to upload and process the Content.


Subject to your compliance with these Terms and Conditions, CEH grants to you a non-exclusive, non-transferable, non-sublicensable licence to access and use the Software in accordance with these Terms and Conditions. You must abide by all applicable copyright laws and by all additional copyright notices or restrictions contained in or associated with the Software.

Intellectual property

All intellectual property rights relating to the Software are owned by CEH or its affiliates or licensors. You acquire no rights or licences in or to the Software other than the limited right to use the Software in accordance with these Terms and Conditions. All rights not expressly granted under these Terms and Conditions are reserved by CEH.

You must not do anything with the Software that is not expressly authorised by these Terms and Conditions. Without limitation, you must not copy, distribute, modify, adapt, decompile or disassemble the Software.

In the event of any third party claim that the Software or your use of the Software infringes that third party’s intellectual property rights, you agree that CEH may (at its option) assume control of the investigation, defence, settlement and discharge of any such intellectual property claim on your behalf.

Liability

To the maximum extent permitted by law, CEH and its affiliates (including Corrs Chambers Westgarth and Corrs Support Services Pty Ltd in its own capacity and in its capacity as trustee of the Corrs Support Services Trust) and their respective directors, officers, employees and agents exclude all liability for any loss or damage (including, without limitation, direct, indirect, special or consequential loss or loss of profits) you suffer, whether arising under contract, tort (including negligence), equity, statute or any other cause of action, or otherwise, as a result of using or accessing the Software or any content, information, products or services available on or from the Software. You release all such entities and persons from all such liability.

You indemnify and hold CEH and its affiliates (including Corrs Chambers Westgarth and Corrs Support Services Pty Ltd in its own capacity and in its capacity as trustee of the Corrs Support Services Trust) and their respective directors, officers, employees and agents harmless from and against any action, claim, liability, loss or expense relating to or arising from your Content or your use of the Software. Without limitation, you indemnify all such entities and persons against any loss or liability they may suffer as a result of a breach of the warranty in paragraph 5.

The Software is provided “as is”. To the fullest extent permitted by law, CEH and its affiliates (including Corrs Chambers Westgarth and Corrs Support Services Pty Ltd in its own capacity and in its capacity as trustee of the Corrs Support Services Trust) exclude all warranties, representations, implied terms and guarantees about the currency, accuracy, suitability or reliability of the Software and any content or information associated with the Software. Without limitation, CEH and its affiliates (including Corrs Chambers Westgarth and Corrs Support Services Pty Ltd in its own capacity and in its capacity as trustee of the Corrs Support Services Trust) do not warrant that:

  • the Software is compatible with your documents or data;
  • functions of the Software (or which you access through the Software) will be uninterrupted or error free;
  • defects will be corrected; or
  • the Software or the server that makes it available is free of errors or viruses, worms or “Trojan horses”.

In respect of any conditions, warranties or guarantees which under statute CEH cannot exclude, to the extent permitted by law, CEH’s liability is limited, at its option, to the replacement, repair or resupply of the relevant goods, or the resupply or a refund of the cost of the relevant services.

To the maximum extent permitted by law, CEH will have no warranty obligation whatsoever with respect to the Software and any claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any applicable warranty will (subject to these Terms and Conditions) be your sole responsibility.

You acknowledge that CEH has no obligation to furnish you with maintenance and support services with respect to the Software or your use of the Software.

General

These Terms and Conditions are governed by and to be interpreted in accordance with the laws of Victoria, Australia and you irrevocably and unconditionally submit to the nonexclusive jurisdiction of the courts having jurisdiction there.

If any of these Terms and Conditions is invalid, unenforceable or illegal in a particular jurisdiction, that term will be struck out for that jurisdiction only and the remaining terms will remain in full force.

If CEH does not act in relation to a particular breach by you of these Terms and Conditions, this will not be treated as a waiver by CEH of any right.

You represent and warrant that:

  • you are not located in a country that is subject to a U.S Government embargo, or that has been designated by the U.S Government as a “terrorist supporting” country; and
  • you are not listed on any U.S Government list of prohibited or restricted parties.

Introduction

Corrs Enterprises Holdings Pty Ltd (ABN 76 613 509 998) (CEH) is committed to protecting the privacy of our customers. This Privacy Policy explains how CEH collects, stores, uses and discloses personal information, including personal information collected in connection with the supply of services through its www.justocr.com website (the Services). Your use of the Services is also subject to the applicable Terms of Use. 

CEH will collect, use and disclose personal information in accordance with the Privacy Act 1988 (Commonwealth) (the Act) and this Privacy Policy.  In this Privacy Policy, “personal information” has the meaning given in the Act.

If CEH updates this Privacy Policy, the updated version will be available at www.justocr.com. CEH may highlight changes to this Privacy Policy on the website, but you should check the Privacy Policy regularly for changes. By continuing to deal with CEH or continuing to use the Services, you accept this Privacy Policy as it applies from time to time.

Collection and use of personal information

CEH will, from time to time, collect and use personal information. The types of personal information collected and the purposes for which that personal information will be used will depend on the circumstances.

For example, CEH may collect personal information from you when you:

  • acquire or use the Services;
  • provide payment information in connection with your use of the Services (this information may be collected via CEH’s third party payment processor); or
  • contact CEH, for example to ask for information or assistance.

The types of personal information that CEH may collect about you include contact details such as your name, address, email address and phone numbers as well as payment information in connection with your use of the Services.  

You acknowledge that the information and documents that you upload to the Services (Customer Content) may contain your personal information or the personal information of others.  CEH will handle Customer Content in accordance with the Terms of Use. You warrant that you have all necessary consents and permissions required to allow CEH to access, use, store and disclose any personal information included in Customer Content as required in order to provide the Services.

 CEH may use your personal information for the purposes:

  • for which it was collected (and related purposes which would be reasonably expected by you);
  • to which you have consented; and
  • as otherwise authorised or required by law.

Some of the specific purposes for which CEH collects, uses and discloses personal information are:

  • to respond to you if you have requested information (including via CEH’s websites or via an email or other correspondence you send to CEH);
  • to provide and improve the Services;
  • to administer and manage payment for the Services, including charging and billing;
  • to contact you regarding the above, including via electronic messaging such as SMS and email, by mail, by phone or in any other lawful manner.

CEH may contact you (or authorise third parties to contact you) in order to provide you with information about the Services.  CEH may also use or disclose your personal information for the purpose of direct marketing if you have consented or if otherwise permitted by law.  If you wish to unsubscribe from CEH’s direct marketing, please contact us using the contact details below.

Disclosure of personal information

CEH may disclose your personal information to third parties including:

  • to its related companies;
  • to its contractors and other third parties that provide goods and services to it (including website and data hosting providers, third party payment processors and other IT suppliers);
  • as part of a sale or prospective sale of CEH or part or all of its assets;
  • where CEH is required or authorised by law to disclose personal information, for example to law enforcement authorities or to prevent a serious threat to public safety; or
  • otherwise with your consent.

Handling of personal information

CEH will take reasonable steps to protect all personal information held by it from misuse and loss and from unauthorised access, modification and disclosure. However, except to the extent liability cannot be excluded due to the operation of statute, CEH excludes all liability (including in negligence) for the consequences of any unauthorised access to your personal information. Please notify us immediately if you become aware of any breach of security.

Transborder data flows

Your personal information may be transferred outside of Australia (including, but not limited to, to the United States of America, Ireland and the United Kingdom) for the purpose of CEH providing you with the Services (including for data processing and storage by third parties). 

The Services are hosted by Amazon Web Services and Customer Content you upload to the Services may be stored on Amazon Web Services’ servers and equipment around the world.  You may have the opportunity to nominate the region(s) in which you would prefer your Customer Content to be stored however CEH does not guarantee that Customer Content will always be stored in your nominated region.

Accessing your personal information

Any person may seek to access, update or correct the personal information which CEH holds about that person. CEH will provide access to that information in accordance with the Act. There are certain exemptions which may apply to the provision of that information. We may require that the person requesting access provide suitable identification and we may charge an administration fee for granting access to information. Requests to access, update or correct personal information held by CEH should be addressed to CEH using the contact details below.

If you have any questions, comments or complaints about CEH’s collection, use or disclosure of personal information, or if you believe that CEH has not complied with this Privacy Policy or the Act, please contact CEH using the details below.
